Buyer
The Buyer’s name, delivery and billing addresses, telephone number and email address are the details supplied when ordering. Those details, together with the order summary and confirmation, form an integral part of this agreement.
2. Subject and legal framework
This agreement governs the parties’ rights and obligations concerning the sale and delivery of goods ordered electronically through the I’m Diamond website. It is subject to Türkiye’s Consumer Protection Law No. 6502, the Regulation on Distance Contracts and other applicable legislation.
3. Product and order information
The product name, model, main characteristics, quantity, unit price, discounts, total price including taxes, delivery charges, payment method and delivery information appear in the order summary shown before the order is completed and in the order confirmation. The product page, pre-contract information, order summary and confirmation form integral parts of this agreement.
4. Price, payment and promotions
The Buyer pays the total shown in the order summary using the selected payment method. Promotions, discounts, vouchers and gifts are governed by the conditions displayed when ordering. Cancellation or return may require promotional conditions to be reassessed; refunds are determined consistently with applicable law and the actual discount applied to the order.
5. Delivery
The Seller delivers within the promised period. Except for goods prepared to the consumer’s individual requirements or personal needs, this period does not exceed thirty days. For genuinely bespoke goods, the production and delivery period disclosed before ordering and accepted by the Buyer applies.
The Seller is responsible for loss or damage until delivery, except where the Buyer chooses a carrier other than one designated by the Seller. If performance becomes impossible, the Buyer is informed and payments are refunded within the statutory periods. Lack of stock alone does not constitute impossibility.
6. Right of withdrawal
For goods not covered by the exceptions below, the Buyer may withdraw within fourteen days of receipt without giving a reason or paying a penalty. Withdrawal is also possible before delivery. Notice must be given before the period expires in writing or on a durable medium, using [email protected], [email protected] or another Seller contact channel listed above.
The Buyer returns the goods within fourteen days of giving withdrawal notice, including all parts, accessories, certificates and any promotional gifts. Inspection necessary to establish the goods’ nature, characteristics and functioning does not remove the right of withdrawal; the Buyer may be responsible for diminished value caused by handling beyond that extent.
7. Exceptions to withdrawal
Unless otherwise agreed, withdrawal is unavailable for:
- Gold and jewellery whose price depends on fluctuations in financial markets beyond the Seller’s control;
- Goods specially made to the Buyer’s individual requirements, such as a custom size, engraving, design, stone, colour or setting, or subsequently personalised goods;
- Goods unsuitable for return for health or hygiene reasons after protective packaging, tape, seals or similar protection has been opened after delivery.
Jewellery is not automatically excluded merely because it is jewellery. Choosing a standard size or colour already available in stock does not, by itself, make an item bespoke. Any exception depends on the actual pricing method, the characteristics of the goods, and whether the order genuinely requires custom manufacture or personalisation.
8. Returns and refunds
For an eligible withdrawal, payments including delivery charges are refunded within fourteen days. The period starts when the goods are handed to the designated return carrier, or reach the Seller if a different carrier is used. Before delivery, it starts when the Seller receives withdrawal notice. Refunds use the original payment method without extra charges, in one payment even for instalment purchases.
You do not pay return shipping when using the carrier identified in the pre-contract information. If no return carrier was identified, you do not pay return costs when using any carrier.
If returning part of a promotional order means the promotion’s conditions are no longer met, discounts and gifts are reassessed consistently with applicable law and the actual discount received. The refund reflects that reassessment.
9. Defective goods
Withdrawal exceptions do not remove the Buyer’s statutory rights regarding defective goods. Where the conditions under Law No. 6502 are met, the Buyer may seek a refund by ending the contract, a price reduction, free repair or replacement with non-defective goods. Return costs for defective goods cannot be imposed on the Buyer.
10. Personal data
Personal data is processed for making and performing the order, payment, delivery, invoicing, after-sales services and legal obligations, in accordance with applicable law and the personal-data information published on the website.
11. Disputes
Within the applicable monetary limits, the Buyer may apply to the consumer arbitration committee at their place of residence or where the consumer transaction took place. Disputes exceeding those limits may be brought before the competent consumer court.
12. Acceptance and records
Before confirming the order, the Buyer electronically declares that they have read and accepted the pre-contract information and this agreement. The agreement is formed when the order is completed. The Seller remains responsible for its legal obligations to provide the agreement and pre-contract information to the Buyer on a durable medium.
